Introduction
What happens when the same high-risk job is performed in Brisbane versus Sydney versus Perth? In 2026, the answer is finally simple for most of Australia — but only if you understand the harmonised WHS jurisdictions.
Welcome to Week 4 of SWMS Mastery: 52 Weeks with MiSAFE. This week we break down exactly which states and territories follow the national model WHS laws and what that means for your SWMS in practice.
What Does “Harmonised WHS” Actually Mean?
Harmonised WHS refers to the model Work Health and Safety laws adopted by most Australian jurisdictions. These laws replaced the old patchwork of state-based rules with a single national framework for safety, including consistent SWMS requirements for high-risk construction work.
The goal? Reduce confusion for businesses that operate across borders and lift safety standards everywhere.
Which Jurisdictions Are Harmonised in 2026?
The following jurisdictions fully follow the harmonised model WHS laws:
- New South Wales
- Queensland
- South Australia
- Tasmania
- Australian Capital Territory
- Northern Territory
- Commonwealth (federal workplaces)
- Western Australia (adopted 31 March 2022)
That covers the vast majority of Australian construction work.
Victoria – The Important Exception
Victoria never adopted the harmonised model. It still operates under its own Occupational Health and Safety Act 2004 and Regulations. While many principles are similar, the exact wording, some triggers, and enforcement approach differ.
If your business works in Victoria, you must understand these differences or risk non-compliance.
Why This Matters for Your SWMS
When you operate across harmonised jurisdictions, one well-written SWMS can usually satisfy requirements in multiple states. But cross into Victoria and you may need adjustments. Knowing the map helps you avoid duplicated work, reduce compliance costs, and stay audit-ready everywhere.
Practical Tips for Working Across Jurisdictions
- Use the harmonised model as your base template
- Add jurisdiction-specific notes where needed (especially for Victoria)
- Always check the latest version of each jurisdiction’s regulations
- Document which rules apply to each site
This approach keeps your SWMS efficient without compromising safety or compliance.
